basalt Water Rights Attorneys

Water rights in Colorado are complex — and navigating them in Basalt requires local experience. Unlike in many other states, water rights are not automatically included with land ownership. Under Colorado’s prior appropriation doctrine, water is allocated based on the principle of “first in time, first in right.” This means that older (senior) water rights are given priority over newer (junior) rights, which can be critical during dry years or low-flow periods on the Fryingpan and Roaring Fork Rivers. Whether you’re buying land, drilling a well, or protecting a historical diversion, knowledgeable Basalt water rights attorneys are essential.

At JVAM, we help clients throughout Basalt and Eagle and Pitkin Counties understand, secure, and protect their rights to water. Our attorneys regularly represent landowners, agricultural users, developers, municipalities, and homeowners associations in water court and during real estate transactions. We know the challenges specific to Basalt’s location at the confluence of two major river systems — and how to ensure your water access is legally defensible and future-proof.

Our water law team brings decades of statewide experience and local relationships to every case. We work closely with water engineers, consultants, and local government entities to help clients develop long-term water supply strategies that align with their goals and obligations.
